SC Accepts BCCI Amendment Eliminating Cooling Off Period

Bench comprising Justices DY Chandrachud and Hima Kohli held that cooling off period will apply after two consecutive terms at either State Association or BCCI. This would clear the decks for extension in the tenure of President Sourav Ganguly and Secretary Jay Shah.

The Supreme Court of India, on September 14, permitted amendments to the BCCI Constitution which pertained to relaxation of cooling off period which required holding one term each as office bearer at State association or Board of Control for Cricket in India (BCCI).

The amendment was accepted by the Top Court on the basis that the it would not dilute the original objective.

Bench comprising Justices DY Chandrachud and Hima Kohli held that cooling off period will apply after two consecutive terms at either State Association or BCCI.

This would clear the decks for extension in the tenure of President Sourav Ganguly and Secretary Jay Shah. 

The BCCI, by way of the proposed amendment to its constitution, had sought the removal of the cooling-off period for its office bearers. The Constitution of BCCI prescribed a mandatory three year cooling off period for an office bearer who had served two consecutive terms of three years each in the state cricket association or the BCCI.
